Employment in Ontario has changed significantly over the past 12 months and will continue to change over the coming years with the introduction of the new Employment Standards Act (ESA) / Bill 148.
This is the most significant amendment to the Employment Standards Act in the past 18 years, and there are important employer actions required following the introduction of the new ESA regulations in Ontario.
Employers now have increased obligations that cover a broad range of employment terms and practices. Additionally, the Act has very aggressive timelines for implementation along with enforcement teams in place to ensure the employers have made the required changes and adjustments to their policies, employment contracts and practices.
The Changes Simplified
To help navigate through these changes, we’ve created a quick two-page Simplified Review Tool to help guide employers through the ESA obligations:
See our Simplified Review Tool for more information.
This tool goes through a summary of each change in the Act, the impact on employers and/or handbooks and subsequent potential issues.
ESA Review & Update
Our full ESA Review and Update program is designed to focus on the specific changes and requirements of the Act with a review of existing documentation in place (employment contracts, policies, handbooks, required notices) as well as undocumented practices and identify gaps with respect to the Act.
This will cover the key areas of amendments including:
- Minimum wage changes
- Holiday pay
- Vacation
- Job protected leaves
- Maternity leave
- Parental leave
- Personal emergency leave
- Leave for death of a child
- Family medical leave
- Critical illness
- New protected leaves
- Equal pay
- Temporary help agency
- placement
- Schedule rules
- Contractors
- Electronic agreements
